My car was hit while it was parked unocuppied in the street. The other drivers insurance claim adjuster told me the driver only has $10,000.00 for damages on his policty. Is this my fault that he has so little coverage . My car value on the date of the accident was worth more. The claim adjuster is giving me less because he is giving me the market value 2 1/2 months later which is the present not when it happen. I want to know what date should I get for a total loss of my car, and If more can I take the insure to small claim court to get the balance of the market value.
